A Decision on the Capital Market Undertakings Act (CMU) Will Be Made in Luxembourg. Our Law Firm Is Involved in the Process.

In the case of our client Fondee, the Court of Justice of the European Union (CJEU) will review whether Section 29(4) of the Capital Market Undertakings Act (CMU) is in conflict with European law. This provision restricts investment intermediaries to transmitting instructions only to domestic investment firms, excluding those licensed by the supervisory authority of another EU Member State. The team, led by Jan Šovar, contends that such a national regulation is impermissible due to its conflict with European law.
