Decision of the European Court of Justice in Luxembourg

Our FINREG PARTNERS office successfully represented a client in a case before the Court of Justice of the European Union (CJEU). The decision concerns the interpretation of the European MiFID II Directive (Directive 2014/65/EU). The decision has significant implications for Czech capital markets legislation, particularly with regard to the transmission of instructions of investment intermediaries abroad. However, the case quietly resonates with a much more significant issue – the maximum or full harmonisation of MIFID2.

Programme of the Meeting with FINREG:

Part 1:

  • Analysis of the case and the CJEU decision: a detailed analysis of the case that led to the CJEU decision and its impact on investment intermediaries.
  • Impact of the decision on the Czech capital market: what specific changes and adjustments will be necessary for Czech investment intermediaries, including practical examples.

Part 2:

  • Discussion on MiFID II compliance of the CCCT: We will discuss possible inconsistencies between the CCCT and MiFID II that may have implications in practice.
  • Practical advice and procedures: we will provide recommendations and procedures on how to adapt to the new requirements and ensure compliance with the legislation.
